Myths About Subletting—Do You Know the Facts?

As a tenant, you can sublet your apartment, but only if you have specific reasons and we at Skövdebostäder have approved the sublet in advance. However, there are some misconceptions—and here we’ll set the record straight. Do you know which of these statements are true or false?

I can use my queue points help a relative or friend. It’s possible to sign a lease for an apartment and then not live there. FALSE!
If you give the apartment to someone else, you’re subletting it—and we at Skövdebostäder must approve that first. Otherwise, it’s not allowed. We only approve it if there are special reasons for doing so.

I need specific reasons to sublet the apartment. TRUE!
These reasons are set forth in the Rent Act. Valid reasons may include:

  • You will be working or studying in another location for a limited period of time.
  • You and your partner want to try living together.
  • You're going on an extended stay abroad.
  • You need a different temporary address because of an illness.

 

I could be penalized if I sublet my apartment without permission. TRUE!
In any case of unauthorized subletting, you risk losing your lease. You will also be barred from renting new housing for two years. Furthermore, if you charge too much for the sublet, it is a criminal offense and punishable by law.

If I’m just going to rent out my apartment over the summer to a relative, I don’t need permission to do so. FALSE!
You always need permission when you rent out your apartment to someone else.

A subtenant automatically takes over the primary lease if the primary tenant gives notice to vacate the apartment. FALSE!
A subtenant can never take over the primary lease if the primary tenant gives notice to vacate the apartment. The apartment is rented out through the housing waiting list.

My name is on the lease. My spouse can take over the apartment if we get divorced. TRUE!/FALSE!
As the leaseholder, you can, in certain cases, transfer the apartment to a spouse or cohabiting partner. You can do this if you have lived in a marriage-like relationship for at least three years.

If the subtenant doesn't pay the rent, the demand for payment will be sent to me as the primary tenant. TRUE!
When you sublet, you are still responsible for the apartment. It is therefore your responsibility to ensure that the subtenant takes good care of the apartment and does not disturb the neighbors. We will also direct our demands toward you if the rent is not paid on time

If I don't charge any extra fee on top of the rent, it's not illegal subletting. FALSE!

You must always have the landlord's approval. Otherwise, it's illegal.

Why are there rules?

  • A fair rental system. People shouldn't be able to bypass the housing waiting list through underhanded means. Everyone should have an equal chance of getting a place to live.
  • Prevent corruption. A subtenant should also have rights. For example, no one should be tricked into paying too much rent.
  • Tenants' Safety. In the event of a crisis or accident at the property, it is important for us, as the landlord, to be able to contact the person living in the apartment.
